Blood test given to deputy involved in killing

Man did so voluntarily
SAN FRANCISCO Sheriff Laurie Smith says the deputy - 27-year-old James Council - has now agreed to let California Highway Patrol investigators examine a blood sample taken shortly after the accident last Sunday.

The sample was taken as part of the sheriff's department internal probe.

Council could have been fired for refusing the test, but he did not have to turn the sample over to CHP investigators looking into possible criminal charges.
