Designer can seek punitive damages in suit

LOS ANGELES Neely Shearer claims she and a friend had passes to go backstage at the end of a concert at the Wiltern last September.

She alleges that a security guard refused to let her through the door, ripped the pass out of her hand, and twisted her wrist. Then he allegedly picked her up by one leg and carried her 20 feet away.

Shearer filed a lawsuit for assault and battery.

In court papers, Shearer says she suffered humiliation and severe emotional distress, and had to stay in bed for several days, missing work.

Live Nation Worldwide, Inc. has denied any wrongdoing. The company also maintains that the level of alleged misconduct by the security guard was not serious enough to warrant such damages.
