Deadly officer involved shooting 'justified'

SAN BERNARDINO, Calif. The District Attorney's Office states that, in reviewing the case, the use of deadly force on Fox was legally justified by both officers to defend themselves and/or others.

Investigators say the two deputies were responding to reports of an armed robbery at a Highland apartment when the suspect ran out the front door. Both fired handguns when they confronted Fox just before 7 p.m. A bullet fired by Fox grazed a deputy's shirtsleeve. Fox was hit when deputies returned fire.

He was taken to Loma Linda University Medical Center, where he died less than two hours later.
