The Orange County District Attorney is seeking the death penalty in the case. The penalty phase of Richardson's trial is set for May 4th.
Investigators say the incident started when Richardson left his Oceanside home wearing a painters' suit, sunglasses, a dust mask and gloves on the morning of February 9, 2007. He went into the Home Depot in Tustin, carrying a black bag, with the intention stealing cash. He approached store employees, demanding money. He then asked for the manager.
Richardson approached Egan, pulled out a gun, and demanded all the cash from the store's safe. When Egan informed him he didn't have access to the safe, Richardson tried to steal money from the store's front cash registers. When Egan tried to stop him, he opened fire, wounding Egan in the stomach. The victim was rushed to Western Medical Center where he died.
