Judge recusal sought in gay-shooting trial

Brandon McInerney is accused of shooting and killing 15-year-old Lawrence King in February 2008 because he was gay. King was allegedly shot in front of other students at the E.O. Green School.

The trial of an Oxnard teen accused of murdering a gay classmate has been delayed.Brandon McInerney, 16, is accused of shooting and killing classmate Larry King in 2008. King was allegedly shot in front of other students at the E.O Green School. The case is being tried as a hate crime.

Jury selection was set to begin Tuesday, but McInerney's lawyers are asking the judge to remove himself from the case because they feel he can't be fair. The judge recently denied their request for more time to prepare.

The judge has five days to respond to the recusal motion. Another judge will hear the legal arguments. Once that is resolved, the trial can go forward.
