Ex-band teacher convicted for sex w/ student

SANTA ANA, Calif. Carlie Rose Attebury, 31, cried as the verdicts were read in a Santa Ana courtroom.

Attebury will be sentenced in January for having sex with a band student when he was a sophomore at El Modena High School in Orange. She was acquitted of committing a lewd act on a child and of dissuading a witness.

Attebury faces up to five years in prison. Her attorney said he will make a motion for a new trial.

The alleged affair lasted from November 2007 to September 2008. Attebury has denied having sex with the teen.

According to a deputy district attorney, the relationship became sexual, and in early 2008, Attebury moved to a house near the boy where they had sex frequently.

Toward the end of their relationship, parents said they spotted Attebury with the student in the bleachers at a school event with her legs wrapped around him. The parents told the principal, and the principal then alerted police.

Former student Miguel Lopez, now 23, tried to blackmail Attebury after somehow finding out about the affair. Lopez demanded nude photos and thousands of dollars from Attebury in exchange for his silence.

Attebury never paid Lopez money, but did give him nude photos of herself. Lopez has since admitted to his blackmailing attempts and has been given three years of probation.
