King's parents won't sue state over Gardner

Records show that the suspect in San Diego teen Chelsea King's murder violated parole in 2007, yet he remained free.

The parents of 17-year-old Poway resident Chelsea King, who was raped and killed by a registered child sex offender, say they will not sue the state of California for damages.Chelsea King's body was found nearly a year ago in a San Diego County park.

John Gardner was sentenced to life in prison without parole for murdering King and 14-year-old Amber DuBois.

Gardner repeatedly violated parole after serving prison time for molesting a 13-year old, yet he was allowed to go free.

Chelsea's father, Brent King, says a lawsuit would force his family to focus on tragedy and pain that followed the death of their daughter.
