Boys accused of rape won't be tried as adults

BANNING, Calif.

The three students at Nicolet Middle School are accused of attacking a female classmate in Roosevelt Williams Park last week. Police say two of the boys held her down while the third raped her.

Police say the 13-year-old alleged victim was at the park with a friend last Monday at about 5:30 p.m. When the friend left for home, the girl decided to leave too. She came across the three boys, who had just arrived at the park.

Police say what then started out as joking between the kids led to sexual fondling and groping. Then, police say, the boys led the girl to the playground where one of them allegedly raped her.

The three are facing felony charges, but Riverside County prosecutors say state law does not allow them to charge the boys as adults because they are under 14.

Since they are minors, their names are not being released.
