OTRC: Erin Andrews files new $10 million lawsuit over nude video case

ESPN newscaster Erin Andrews said on Friday her participation in 'Dancing With the Stars' was a 'perfect distraction' from a stalking case that had resulted in nude videos of her being leaked on the Internet.

Erin Andrews, an ESPN reporter and former "Dancing With The Stars" finalist, has filed a new $10 million lawsuit against a Chicago man who secretly videotaped her naked and against a hotel where such a taping allegedly took place.

The person in question, Michael Barrett, is currently serving a two-and-a-half-year sentence in a federal prison in South Carolina. The 50-year-old man pleaded guilty last year to stalking Andrews, 33, removing hotel door peepholes to shoot video of her nude with his cell phone and to posting the footage online. He is due to be released in July 2012.

Andrews had last year sued her imprisoned stalker, as well as several hotels where he secretly filmed her nude, for invasion of privacy, negligence and emotional distress. She recently refiled her lawsuit to ensure the statute of limitations would remain, according to the Reuters news wire. She is seeking at least $6 million from the West End Marriott in Nashville and $4 million from Barrett.

Andrews said in her original complaint that the incident took place around Sept. 2, 2008. A Marriott spokesperson told The Tennessean that since then, the company has updated its "guest registration procedures to further enhance guest privacy." The hotel chain has not addressed Andrews' lawsuit specifically.

"We do not comment on pending litigation," a Marriott representative told OnTheRedCarpet.com.

Andrews claims in her suit that Barrett phoned the West End Marriot, successfully obtained information about her reservation and then reserved a room next to hers. She said he removed and altered her door's peephole, secretly recorded her changing her clothes and posted the video online. Andrews added that she found out about the footage almost a year later, in July of 2008.

Andrews says she continues to suffer "great emotional distress and embarrassment" as a result of the ordeal and says the hotel's staff members were "negligent" because they revealed her location and failed to discover what Barrett had done.

"Although I'll never be able to fully erase the impact that this invasion of privacy has had upon me and my family, I do hope that my experience will cause the hospitality industry to be more vigilant in protecting its guests from the time they reserve a hotel room until they check out," Andrews said in a statement last year.

She added that since Barrett's sentencing, she still suffers fear, anxiety and public humiliation as a result of the case. Andrews had also said her participation in ABC ballroom dancing show "Dancing With the Stars" in 2010 marked a "perfect distraction." She and partner Maksim Chmerkovskiy placed third.
