The state Assembly is set to take up new legislation designed to make it easier for school districts to fire teachers accused of gross misconduct.

The state Senate on Tuesday approved the bill, which comes in response to the Miramonte Elementary School scandal. Mark Berndt was arrested for allegedly blindfolding his students and spoon-feeding them his semen.

SB1530, by Democratic Sen. Alex Padilla, would allow school boards to dismiss teachers instead of leaving the decision to a disciplinary commission. It pertains to cases of violent, sexual or drug offenses involving children.

Teachers unions oppose the legislation, saying it erodes the right to due process.
