Halle Berry's ex-boyfriend Gabriel Aubry, the father of her child, has been arrested and booked on suspicion of battery after getting into a physical altercation with the Oscar-winning actress' fiance, Olivier Martinez.
The incident occurred on Thursday morning -- Thanksgiving Day -- as Aubry was dropping his and Berry's 4-year-old daughter Nahla at the actress' Beverly Hills home to celebrate the holiday, the Los Angeles Police Department told People magazine.
The child did not witness the fight, a source close to the matter told KABC Television, OTRC.com's parent company, adding that Berry saw the beginning of it and rushed to call 911, reporting an assault with a deadly weapon. It is unclear if any were found.
Aubry was placed under citizen's arrest and taken to a nearby hospital. Hours later, in the afternoon, he was transported to a police station in downtown Los Angeles and booked formally for misdemeanor battery, police sources told KABC. He was released hours later at 6:25 p.m. Pacific Time after posting a $20,000 bond. He was scheduled for a December 13 court date.
The police sources said that it appears Aubry started the fight and that Martinez "apparently gave back more than Gabriel dished out." Aubry suffered fractured ribs and his face was bruised, a source close to the situation said, adding that he had punched and pushed Martinez, who injured his hand and neck but appears to be okay.
Berry, Aubry and Martinez have not commented. The news comes amid a custody battle between the actress and Aubry over their child. Two weeks ago, a Los Angeles denied Berry's request to move to France with her.
While Aubry was treated in the hospital, a Los Angeles judge issued an Emergency Protective Order (EPO) against him. It is valid until December 3 and dictates that Aubry must stay at least 100 yards away from Berry, their daughter and Martinez.
Berry and Aubry, a model, dated for four years before splitting up in April 2010. Their relationship became contentious as they battled over custody issues, including Berry's busy filming schedule and her accusations that her daughter was "traumatized" after a visit with Aubry.
In January 2012, Berry's nanny, Alliance Kamdem, was denied a restraining order request against Aubry after he allegedly pushed her while she was carrying Nahla.
Berry and Martinez, an actor, became engaged earlier this year. They met on the set of the movie "Dark Tide" around the summer of 2010.
