No criminal charges after CA nurse refuses to perform CPR

BAKERSFIELD, Calif.

Lorraine Bayless, 87, passed away at Glenwood Gardens on Feb 26. The public release of the 7-minute 911 recording caused national outrage. The nurse refused to perform CPR, citing the facility's policy.

The company that owns the facility said the nurse had misinterpreted the company's guidelines and was on voluntary leave pending an internal investigation.

Bayless' family members said that she would not have wanted CPR and they had no intention of suing.

Bakersfield police said that the case is closed. Sgt. Jason Matson said Thursday the investigation had looked into whether the incident constituted elder abuse, but did not reveal criminal wrongdoing.
