OTRC: Reese Witherspoon arrested for disorderly conduct, husband for DUI

Reese Witherspoon, star of "Legally Blonde" and "Cruel Intentions," was arrested for disorderly conduct in Atlanta on Friday, April 19, after mouthing off to cops following her husband Jim Toth's arrest for suspicion of DUI.

Toth is accused of driving under the influence and in the wrong lane and has not commented. The actress said in a statement: "I clearly had one drink too many and I am deeply embarrassed about the things I said. It was definitely a scary situation and I was frightened for my husband, but that is no excuse. I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I'm very sorry for my behavior."

Witherspoon was handcuffed after disobeying repeated instruction from the arresting officer. She had argued with him after he told her to stay inside the vehicle while her husband was given a field sobriety test.

"Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer," an officer said, according to a police report. "I told Mrs. Witherspoon to sit on her butt and be quiet."

After Toth was placed under arrest, Witherspoon then proceeded to exit the vehicle, and was instructed to get back in the car. According to the report, she "stated that she was a 'US citizen' and that she was allowed to 'stand on American ground.'"

The report quotes a police officer as saying: "Mrs. Witherspoon asked, 'Do you know my name?' I answered, 'No, I don't need to know your name.' I then added, 'right now.' Mrs. Witherspoon stated, 'You're about to find out who I am.'"

"Mrs. Witherspoon also stated, 'You are going to be on national news.' I advised Mrs. Witherspoon that was fine,'" the report continued.

According to the outlet, both Witherspoon and Toth were released at 3:30 a.m. on Saturday morning, and a court appearance is scheduled for 8 a.m. on Monday -- though their attorney is expected to request that the court date be postponed.

The actress was in Atlanta with Toth shooting her upcoming drama film, "The Good Life," which also stars Corey Stoll and Sarah Baker. She can be seen next in "Mud," which also stars Matthew McConaughey and is set for release on April 26. Witherspoon walked the red carpet at the New York premiere of the movie on Sunday night but did not talk to reporters.

Witherspoon and Toth have been married since March 2011. They welcomed their first child together, a son named Tennessee James Toth, on Sept. 17, 2012.
