Justin Bieber sued by paparazzo for alleged May 2012 assault

Celebrity photographer Jose Osmin Hernandez Duran claims Bieber jumped out of a van after screaming obscenities at him and other celebrity photographers who were taken pictures of the entertainer as he and then-girlfriend Selena Gomez left the movie theater at The Commons Shopping Center in Calabasas.

Duran says Bieber ran straight for him and attacked him.

"He kicked me, punched me, and pushed me up against a car. I did not retaliate even though he was attacking me because I did not want to hurt him," said Duran. "No one should treat another person the way Justin Bieber treated me."

Duran's attorney, Steven Madison, said that Gomez got out of the vehicle at one point and tried to calm Bieber down.

Duran said unfortunately no one was able to capture pictures of the actual attack because it happened behind a car. Duran said that while he was not seriously hurt, he did suffer some bumps and bruises.

He has filed a civil lawsuit against Bieber, alleging assault, battery, negligence and emotional distress.

"I am bringing this lawsuit to hold Justin Bieber responsible for his actions," said Duran.

Madison said there were witnesses.

"People were watching aghast, and Mr. Duran was pleading with Mr. Bieber with his hands raised in a very submissive position to just stop," said Madison.

Justin Bieber's attorney, Howard Wietzman, issued a one word statement: "Seriously?"

The District Attorney's Office did not file charges against Bieber following the alleged attack. Prosecutors said that out of all the videos and photographs taken at the scene, there was nothing indicating a physical altercation took place between Duran and Bieber.

Duran's attorney would not say how much money his client is seeking in the lawsuit.
