The man convicted of killing an LAPD officer in 1983 has successfully appealed his death sentence.Officer Paul Verna had been gunned down during a traffic stop in Lake View Terrace in June 1983.

The California Supreme Court found that the presiding judge was wrong to bar Kenneth Earl Gay from offering additional evidence during the penalty phase of his retrial.

The evidence was a statement from a co-defendant that he was the sole shooter. Another trial will be held to determine Gay's sentence.
