District sued after gay student killed

VENTURA, Calif. Larry King, 15, was fatally shot and E.O. Green Junior High School in February. His family is now suing the Hueneme school district, seeking unspecified damages.

His parents are blaming the district for not enforcing its dress code and allowing him to wear makeup and feminine clothing. They claim that opened King up to abuse at school for being gay and that it eventually led to his killing.

Another student, Brandon McInerney, is being charged as an adult with the murder and also faces a charge of committing a hate crime.

McInerney pleaded not guilty to the shooting last week.
