Jurors convicted Alvarez under a state law making it a felony to kill someone during the commission of another violent felony, in this case arson.
According to the Daily News, because no one died in the fire, lawyers for Alvarez want the conviction overturned.
If that happens, prosecutors would be unable to re-try Alvarez for train wrecking, on which he was acquitted.
