Appeals court: LAPD not negligent in 2005 shooting of toddler

An appellate court has ruled that the Los Angeles Police Department's SWAT team wasn't negligent in the shooting of a 19-month-old girl during a hostage rescue in 2005.

Suzie Pena was killed by a SWAT officer's bullet after the team entered a car dealership in Watts where she was being used as a shield by her father, who was armed and fired at officers.

The appellate court found that the force used was reasonable.

The decision affirms a Superior Court judge who dismissed the family's case in 2009.
