Hatch was sentenced to nine months for failing to pay taxes on the $1 million he won on the first season of the CBS show "Survivor."
In a brief filed Thursday, Hatch said the lower court overlooked several factors in finding that he violated the terms of his supervised release by failing to file amended tax returns for 2000 and 2001.
Hatch also argued the March sentence is unreasonable and exceeds prosecutors' recommendations by three months. He wants the appeals panel to order the lower court to toss out the case or order further hearings. Hatch is imprisoned in West Virginia.
