Ramirez was arrested on May 22 in the case, but LAPD Chief Charlie Beck last week publicly exonerated Ramirez when announcing that two others had been arrested and charged in the attack.
"More than anything I'm upset. Not for myself but for the grief and embarrassment that my friends, family and loved ones have been put through," he said. "Everyone is asking what am I going to do next. My only focus and attention is with the writ that has been filed this week. I know the judge in Superior Court will do the right thing."
Attorneys for Ramirez filed a petition on Wednesday to release Ramirez from prison, claiming he was denied due process in his parole hearing.
Ramirez is currently at the Richard J. Donovan Correctional Facility in San Diego. He was sentenced to 10 months for the parole violation.
