Benjamin Mittendorf allegedly confessed to killing his brother

ST. CLOUD, Fla. -- Police said a man killed his brother after an argument over a cheeseburger.

Officials stated the incident happened after Cinco de Mayo festivities in Florida.

According to St. Cloud police, 25-year-old Benjamin Middendorf said he was being bullied by his older brother Nicholas Middendorf.

When they both went for the cheeseburger, investigators said Benjamin Middendorf had enough and shot and killed his brother.

"You know, it is Mother's Day weekend and in this particular case, the mom has lost two sons," said Denise Robert of the St. Cloud Police Department. "One whose deceased, and then the other son who's now incarcerated and facing homicide charges."

A judge has ordered Benjamin Middendorf to be held without bond.
