LOS ANGELES (KABC) -- A woman is accusing Chicago Bears defensive end Ray McDonald of sexually assaulting her and his former teammate San Francisco 49ers linebacker Ahmad Brooks of groping her while she was unconscious.

The 22-year-old claims in a civil lawsuit filed Tuesday in Santa Clara County that she slipped and fell on a pool deck at McDonald's home in San Jose after a night of drinking in December 2014. At one point, Brooks groped her and McDonald carried her upstairs to his bedroom and sexually assaulted her, the suit alleges.

The woman filed a police report in December, but no charges have been filed against McDonald. The Santa Clara County district attorney is still investigating.

In March, McDonald filed a defamation suit against the woman. He contends that the sex was consensual and surveillance video from his home would prove it.

At a news conference Wednesday, the woman's attorney Gloria Allred said her client was not going to "live in fear of him (McDonald) anymore."

"We don't want rich and powerful athletes to be able to deter people from filing against them by filing civil lawsuits against them. That would have a chilling effect and they might be deterred from reporting," Allred said.

Allred has filed a motion to have McDonald's suit thrown out.

McDonald's attorney did not immediately return calls for comment.

The rape accusation quickly ended McDonald's playing days in San Francisco. The team cut him immediately after the investigation became public. He has since been picked up by the Chicago Bears.

This wasn't McDonald's first scrape with the law. Last summer, he was arrested for suspicion of domestic abuse, but charges were never filed.
