LOS ANGELES (KABC) -- "Django Unchained" actress Daniele Watts was charged on Tuesday with lewd conduct. The 28-year-old was briefly detained in September after she was found in a parked car with her boyfriend.

Watts and her boyfriend, Brian Lucas, 43, were each charged with a single misdemeanor count that carries a maximum sentence of six months in jail and a $1,000 fine, according to the Los Angeles City Attorney's Office,.

The actress was placed in handcuffs last month after police said she refused to provide identification to an officer, who was investigating a citizen's report of two people "involved in indecent exposure" in a silver Mercedes-Benz in Studio City. Police released her after determining that no crime was committed.

Following the incident, Watts claimed the only thing she did was kiss her boyfriend while sitting in a car and said she doesn't understand why she was treated like a criminal by police. The incident went viral after Watts and Lucas claimed on their Facebook pages that the detention reflected racial profiling.

The two said they were talking to the ACLU and the NAACP to weigh their options and decide if they will take any legal action against the LAPD.

Police said they followed proper protocol while investigating the 911 call and local civil rights activists demanded that Watts apologize for suggesting race played a role in the confrontation.

Arraignment for Watts and Lucas is set for Nov. 13.
