Arraignment delayed again for accused killer of Pomona SWAT officer

LOS ANGELES (KABC) -- The man accused of shooting to death a Pomona SWAT officer appeared in court Thursday, but his arraignment was postponed.

David Martinez, a suspected Mongols motorcycle gang member, has been charged with capital murder, with the special circumstance of murder of a police officer engaged in his duties.

Officer Shaun Diamond, 45, was shot in the back of the head on Oct. 28 while serving a search warrant in San Gabriel. Authorities said the warrant was part of a sweep targeting criminal motorcycle gangs.

The arraignment hearing was delayed until Dec. 3. Martinez, 36, is being held without bail.

Prosecutors have not yet announced whether they plan to seek the death penalty.
