LOS ANGELES (KABC) -- "Modern Family" star Sofia Vergara is in the middle of a legal battle. Her ex-fiance is suing her over two frozen embryos.
In November 2013, six months before Vergara and businessman Nick Loeb broke up, they used in-vitro fertilization to create embryos, and the plan was to eventually use a surrogate.
There's a signed agreement that says the embryos should be destroyed in the event of either or both of their deaths.
But Loeb, who is pro-life, has filed a complaint in court to prevent them from ever being destroyed. He claims the actress would not agree to that.
The complaint is not alleging that Vergara is actively trying to destroy the embryos.
Loeb also claims in the lawsuit that she physically abused him on four separate occasions.
Vergara is currently engaged to "Magic Mike" star Joe Manganiello.
An attorney for Vergara said they had no comment, and the reproductive center said in a statement, "I am ethically obliged to issue no statements with respect to matters pertaining to or related to ART Reproductive Center."
