Joshua Packer, 21, is accused of entering the house of Brock and Davina Husted in 2009 and fatally stabbing both of them. Davina Husted was pregnant at the time. Packer is facing three murder felonies, as well as robbery and burglary charges.
Packer's attorney requested the charges be dropped, alleging prosecutorial misconduct. Benjamin Maserang, Packer's attorney, claims prosecutors withheld information that a crime scene fingerprint was lifted from a motorcycle helmet. The print did not match Packer or the victims.
Prosecutors allege the murderer wore a motorcycle helmet when he entered the house.
Ventura County Superior Court Judge Patricia Packer denied the motion Tuesday and set an April 1 trial date.
