Bobby Brown charged with DUI in Tarzana

LOS ANGELES

The singer is accused of driving under the influence, driving with a blood alcohol level of more than .08 and driving on a suspended license.

Brown's attorney concedes her client was talking on his cellphone before he was pulled over Monday, however she said Brown was not driving erratically.

The 43-year-old failed a field sobriety test, according to the CHP. He was released from jail without having to post bail.

Brown faces up to a year in jail. His first court appearance is scheduled for April 16.

Brown is the ex-husband of the late Whitney Houston and a founding member of the group New Edition.

He had previously been convicted of driving under the influence. In 2003, he was also arrested for misdemeanor battery against Houston.
