Jonathan Kirby, 56, was charged with first-degree burglary. According to the Los Angeles County District Attorney's Office, Kirby is a third-strike offender. Prosecutors are expected to set bail at $1.1 million.

The "NCIS: Los Angeles" actor and rapper's home was broken into Wednesday. He heard suspicious sounds in his house at around 1:30 a.m. and went downstairs to check it out. LL was not injured in the incident. Kirby, however, remains hospitalized with a broken jaw, nose and ribs.

If convicted, Kirby faces a maximum sentence of 38 years to life in prison.
