Lawsuit filed after shocking video shows delivery driver punching man at California gas station

ELK GROVE, Calif. (KABC) -- Shocking surveillance video shows a delivery driver in an Amazon uniform punching a man at a gas station just outside of Sacramento. Now, the victim has filed a civil lawsuit against Amazon.

Attorney Tony Buzbee shared the surveillance video on social media, writing that his client -- the man seen being punched -- is a 71-year-old auditor of agricultural and animal production facilities.

According to Buzbee, the man stopped at an ARCO Gas Station in Elk Grove, California, to use the restroom and purchase a drink.

The delivery driver was apparently upset with the man and accused him of taking his parking spot.

Buzbee says the driver reacted "hyper aggressively," confronting the man in the parking lot, following him into the store and hitting him from behind.

The video shows the man fall to the ground after being hit.

According to the attorney, the 71-year-old man is being treated for neck pain and a concussion.

Buzbee says the delivery driver was arrested and charged with felony battery and elder abuse, among other charges. He added that he believes the man has a history of violence.

"Amazon delivery folks must be carefully screened and trained. Amazon must do better in the hiring process. When Amazon fails, like here, it must be held accountable," Buzbee wrote on social media. He said his client's civil case against Amazon is on file in the Superior Court of California, Sacramento County.

ABC News reached out to Amazon, and a spokesperson said the incident occurred on March 30. The spokesperson noted that the driver was working for an independent business that contracts with Amazon to deliver packages.

After an investigation, Amazon shared the details with the third-party company, and the driver was no longer eligible to deliver Amazon packages, according to the spokesperson.
