Lawyer: Eric Dane video not a sex tape

NEW YORK Dane's attorney told /*People magazine*/ the tape shows a consensual and private moment between the couple and a third woman, believed to be 2002's Miss Teen USA. The participants are nude and shown in compromising situations.

Dane's lawyer says if anyone exploits the tape, they will be violating his client's rights, and will be exposed to significant liability.
