Police arrested Hernandez (D-West Covina) in a hotel parking lot on Tuesday. Officers say the West Covina assemblyman was weaving in between the lanes.
Hernandez told a Sacramento newspaper he had a couple of drinks during a late dinner, but insisted he was sober when officers stopped him.
Police are awaiting the results of a blood test before deciding whether or not to send the case to the district attorney's office.
