Court: No gay marriages in Calif. during Prop 8 appeal

March 24, 2011 12:00:00 AM PDT
A federal appeals court has refused to allow gay marriages in California while it considers the constitutionality of Proposition 8, the state's ban on same-sex marriage.

Supporters of gay marriage wanted the 9th U.S. Circuit Court of Appeals to lift a stay on same-sex marriages while the appeal of the ban makes its way through the courts, but the court said no on Wednesday. The appeals process could take years.

Once the state's high court makes its decision, the case will resume in the 9th Circuit. Once a decision is rendered there, the case would likely head to the U.S. Supreme Court.
