A judge turned down her request to dismiss a neighbor's lawsuit that claimed the singer made a racket by using her New York City apartment as a rehearsal studio.
The man is suing Madonna and the building's co-op board. They said the noise never topped legal levels.
The judge said the dispute warrants a trial.
Madonna has not commented.
