The picture was taken after Rihanna was assaulted by her then-boyfriend, Chris Brown. The photo later ended up on the celebrity gossip website TMZ.
Prosecutors said they didn't have enough evidence to show the tabloid paid officers for the photos. Officers Blanca Lopez and Rebecca Reyes, however, may still be fired for the leak. They are set to appear before disciplinary panels in August.
Prosecutors allege that Reyes took a picture of the photo with her phone and sent it to herself from her LAPD email address to her personal email address.
Phone records showed that Reyes and Lopez made multiple phone calls to Fox Television and TMZ. But a money trail was not discovered tying the leak to them, prosecutors said.
Brown pleaded guilty to the February 2009 assault and was ordered to serve five years on supervised probation and to complete six months of community service.
