A San Bruno resident affected by the deadly gas line explosion is suing Pacific Gas and Electric Co.Steve Dare filed the suit in San Mateo County Superior Court on Friday. Dare said that PG&E should turn over a $100 million recovery fund to a third party. He also said that the utility should pay other monetary damages.

The lawsuit claims that the company could withhold the $100 million funding or not follow through on its promise if the money is not placed in an escrow account that is supervised by the court.

Dare rents a home that was not damaged from the fire, but he was evacuated for three days.

The massive blast on Sept. 9 destroyed nearly 40 homes, severely damaged dozens more and killed at least four people.
