Alleged LA killer of 4 evaded third strike

LOS ANGELES Prosecutors at the time did not seek California's three-strikes law against John Ewell, 53.

Ewell has pleaded not guilty to murdering four people in home invasions in Hawthorne and Los Angeles this past September and October.

In 1994, with two felony robbery convictions, Ewell was charged with forgery.

Prosecutors could have asked for a three-strikes sentence, but did not, as is often the case with non-violent crimes.
