Toledo councilwoman may be off primary ballot

Toledo, OH According to the city charter, candidates have a five day window to accept their nominations in writing. The board of elections did not get Webb's until it was too late.

"I signed it and intended and mailed it within the 5-day window," Webb told 13abc. "but I think the U.S. Post Office kept it for a week."

Webb is already running her campaign for re-election. Her name is on lawn signs, and she says, on the ballots already printed.

A copy of the letter obtained by 13abc shows Webb signed an acceptance of nomination on July 28th, within a five day window required by the city charter.

The Lucas County Republican Party claims Webb may have signed it on time, but it did not get to the Board of Elections before the deadline.

Lucas County Republican Central Committee member Mark Nowak writes:

"Ms. Webb dated her acceptance of nomination on Thursday, July 28, 2011, but she did not file her acceptance of nomination with the election authorities until Thursday, August 4, 2011."

"Ms. Webb failed to file with the election authorities a written acceptance of nomination within 5 days of being notified ... I request that the Board of Elections decertify Ms. Webb as a candidate."

"Getting me off the ballot means voters in District 6 will not have a true choice," countered Webb, "and that's not fair."

Douglas DeCamp is the Republican challenger for district six. If Webb is not valid as a Democratic candidate, the September 13th primary election would be down to DeCamp and Green Party candidate Sean Nestor. The two candidates would then go on to compete in the November election.

"Unfortunately, the outcome for Ms.Webb, if they follow the rules, is that she's off the ballot," Noted DeCamp, 36.

Webb argues her intentions were clear because she circulated her own nominating petition. The charter language also appears clear, but its interpretation is now in the hands of a four member board.

The board is set to meet Thursday at 2 p.m.

Those four members are evenly split - 2 democrats, 2 republicans. If their votes are divided, the tie-breaker goes to the Secretary of State John Husted, a Republican.
