The great-grandson of cosmetics giant Max Factor was originally sentenced to 124 years in prison, but on Monday, Ventura County Superior Court Judge Kathryne Ann Stoltz set that aside. She decided to grant Luster another hearing, saying his trial judge failed to give specific reasons for imposing consecutive sentences.
"The guy got truly hammered, so I think the judge felt that, you know, this really isn't consistent with what typically someone would be sentenced to for these type of offenses," said ABC News legal analyst Dana Cole.
In 2003, Luster was convicted of 86 felony counts while on the lam. Jurors saw videotapes he had made of himself engaging in sex acts with some of the women. He was captured the same year in Mexico by bounty hunter Duane "Dog" Chapman.
Luster wanted more than a new sentencing hearing. He argued he was denied proper representation, but the judge rejected his bid for a new trial. His next hearing is set for April 4.
